Terms of Service

These Terms of Service govern your use of the BytesNCables LLC website and your requests for estimates, consultations, installations, service calls, dispatch work, low-voltage, IT infrastructure, security, access control, Wi-Fi, VoIP, audiovisual and related technology services.

Important: A written proposal, statement of work, invoice, service ticket, purchase order, master services agreement or other signed agreement may include additional or different terms. If there is a direct conflict, the signed written agreement for that project controls for that project.

1. Acceptance of terms

By accessing our website, submitting a form, requesting a quote, approving a proposal, scheduling service, paying an invoice, or otherwise using our services, you agree to these Terms of Service. If you act for a company, property owner, tenant, general contractor, agency or other organization, you represent that you are authorized to bind that organization.

If you do not agree to these terms, do not use our website or services.

2. Company and services

BytesNCables LLC provides technology infrastructure and field services, including structured cabling, network wiring, fiber cabling, security camera installation, access control, business Wi-Fi, VoIP phone systems, audiovisual services, residential technology services, nationwide dispatch and related consulting, installation and support services.

Services may be provided by BytesNCables employees, technicians, subcontractors, dispatch partners or vendor partners under our coordination. Specific deliverables, timelines, equipment and pricing are defined in the applicable written proposal, estimate, invoice or statement of work.

3. Website use

You may use our website for lawful purposes, including learning about our services, requesting information, contacting us, reading content and requesting estimates. You agree not to:

  • use the website for unlawful, fraudulent, deceptive or harmful purposes;
  • attempt to gain unauthorized access to our website, systems, accounts or networks;
  • interfere with website operation, security or performance;
  • submit malicious code, spam, false information or content that infringes another person's rights;
  • scrape, copy or republish website content at scale without permission; or
  • use our name, logos, content or service descriptions in a misleading way.

We may suspend or block access to the website if we believe activity violates these terms or threatens security, availability, users or our business.

4. Quotes, estimates and proposals

Quotes and estimates are based on information available at the time they are prepared. They may rely on client-provided details, visible site conditions, assumptions about access, available pathways, existing infrastructure, code requirements, equipment availability and project timing.

Unless a written proposal states otherwise:

  • estimates are not binding until accepted in writing by both parties;
  • pricing may change if scope, site conditions, materials, labor requirements, travel, permits, deadlines or client requirements change;
  • taxes, permit fees, shipping, lift rental, after-hours labor, parking, access fees and special-order materials may be billed separately if not included;
  • lead times are estimates and may depend on product availability, site readiness, approvals and third-party schedules; and
  • verbal statements do not modify a written proposal unless confirmed in writing.

5. Client responsibilities

You are responsible for providing accurate information and reasonable cooperation so we can perform the services safely and efficiently. Client responsibilities may include:

  • confirming that you have authority to request work at the site;
  • providing accurate service addresses, contacts, building rules, drawings and project requirements;
  • obtaining owner, tenant, landlord, property manager, HOA, IT, security, union, after-hours or other approvals unless our written scope says we will handle them;
  • providing safe access to work areas, telecom rooms, ceilings, closets, risers, conduits, electrical rooms and equipment locations;
  • identifying known hazards, restricted areas, asbestos, lead paint, mold, water damage, firestopping requirements, energized equipment or other site risks;
  • maintaining backups of data, configurations and business-critical systems before service begins;
  • providing needed credentials, admin access, passwords, MFA approvals, network details and vendor access in a secure manner;
  • ensuring that power, internet service, rack space, pathways, mounting surfaces and required third-party services are available when needed; and
  • reviewing and approving completed work, change orders and invoices promptly.

6. Scheduling and access

Appointments are scheduled based on technician availability, service location, project priority, materials, weather, traffic, site access and other operational factors. We will make reasonable efforts to meet scheduled windows, but appointment times are estimates unless a written agreement says otherwise.

If we cannot access the site, cannot reach the site contact, are delayed by site rules, or cannot perform work because the site is not ready, we may charge for travel, standby time, rescheduling, restocking or other costs as allowed by the applicable proposal or law.

7. Scope changes and concealed conditions

Low-voltage and technology work can reveal hidden conditions that are not visible during estimating. Examples include blocked pathways, missing conduit, damaged cabling, unsafe conditions, code issues, inaccessible spaces, unexpected firestopping, structural limitations, obsolete equipment, undocumented network settings and interference from third-party systems.

If conditions or client requests require work outside the accepted scope, we may issue a change order or revised estimate. Additional work, materials, trips, expedited shipping, lift rental, after-hours labor, testing, remediation or troubleshooting may be billed separately.

8. Equipment, materials and third-party products

Equipment and materials may include cabling, racks, patch panels, cameras, access control hardware, wireless access points, network equipment, phones, audiovisual devices, software licenses and related parts. Unless a written agreement says otherwise:

  • equipment availability, pricing and model numbers may change based on supplier conditions;
  • we may recommend substitutions that are reasonably comparable if specified products are unavailable;
  • manufacturer warranties, license terms, cloud subscriptions and support policies are controlled by the manufacturer or provider;
  • software, cloud services, monitoring services, SIM plans, recurring licenses and manufacturer accounts may require separate third-party terms; and
  • title to equipment and materials passes to the client only after full payment unless a written agreement says otherwise.

9. Payments and invoices

Payment terms are stated in the applicable quote, proposal, invoice, service ticket or written agreement. If no separate payment term is stated, payment is due upon receipt of invoice.

We may require deposits, progress payments, prepayment for special-order materials, or payment before release of final documentation. You agree to pay approved charges, taxes, fees, reimbursable expenses and other amounts due. Late balances may be subject to service suspension, collection costs, reasonable attorney fees, interest or late fees to the extent permitted by law and the applicable agreement.

If you dispute an invoice, you must notify us in writing within 10 days after receipt and identify the specific item disputed. Undisputed amounts remain due.

10. Cancellations and rescheduling

To cancel or reschedule a service appointment, contact us as soon as possible. Depending on the project and timing, cancellation or rescheduling may result in charges for labor reserved, travel, site visit preparation, special-order materials, restocking fees, permits, vendor charges, equipment rentals or other non-recoverable costs.

Special-order, custom-configured, opened, installed or client-approved equipment may be non-returnable or subject to manufacturer/vendor return policies.

11. Security system limitations

Security systems reduce risk but do not eliminate risk. Cameras, access control, alarms, locks, networks and monitoring integrations can fail, be bypassed, lose power, lose internet connectivity, experience configuration issues, or be affected by user error, vandalism, weather, cyber incidents or third-party outages.

Unless a signed written agreement specifically says otherwise, BytesNCables does not provide police, fire, medical, emergency dispatch, guard, 24/7 monitoring or incident response services. We do not guarantee that a system will prevent crime, loss, injury, unauthorized access, data loss or property damage.

You are responsible for using systems lawfully, including complying with applicable surveillance, audio recording, access control, employment, tenant, visitor, signage, notice, consent and data retention rules. You are also responsible for account administration, user permissions, password management and lawful placement and operation of cameras, microphones, access devices and related equipment unless a written agreement assigns specific responsibilities to us.

12. Network, data and credential access

Some services may require access to client networks, devices, cloud dashboards, administrator accounts, credentials, MFA approvals, IP schemes, firewall settings, camera systems, access control platforms, phone systems or data rooms. You authorize us to use access you provide solely for the requested services.

You are responsible for maintaining backups and for protecting business-critical data before work begins. Unless expressly agreed in writing, we are not responsible for data backup, data restoration, business continuity, cybersecurity monitoring, incident response, compliance audits or ongoing network administration.

For security, avoid sending passwords through ordinary email or text when a safer method is available. You should rotate temporary credentials after work is complete and remove accounts or permissions that are no longer needed.

13. Warranties and disclaimers

BytesNCables will use commercially reasonable efforts to perform services in a professional manner consistent with the accepted scope. Any specific workmanship warranty, service warranty, response commitment or service level must be stated in the applicable written proposal or agreement.

Third-party equipment, software, cloud services, subscriptions and manufacturer platforms are provided under the applicable manufacturer's or provider's warranty and terms. We do not control manufacturer warranty decisions, product updates, cloud availability, firmware changes, license rules or third-party service outages.

Except as expressly stated in a written agreement, the website and services are provided to the maximum extent permitted by law without implied warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation or error-free performance. Some jurisdictions do not allow limitations on implied warranties, so some limitations may not apply to you.

14. Limitation of liability

To the maximum extent permitted by law, BytesNCables LLC and its owners, employees, technicians, subcontractors, vendors and affiliates will not be liable for indirect, incidental, consequential, special, exemplary or punitive damages, including lost profits, lost revenue, lost data, loss of use, business interruption, reputational harm or replacement services, even if we have been advised of the possibility of those damages.

To the maximum extent permitted by law, our total liability for a claim related to a service, project or website use will not exceed the amount paid to BytesNCables for the specific service or project giving rise to the claim during the three months before the event giving rise to liability. This limitation does not limit liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless BytesNCables LLC and its owners, employees, technicians, subcontractors, vendors and affiliates from claims, damages, losses, liabilities, costs and expenses, including reasonable attorney fees, arising from your breach of these terms, your instructions, your site conditions, your misuse of systems or services, your violation of law, your unauthorized recording or surveillance, your failure to obtain required approvals, or information you provide to us.

16. Privacy

Our collection and use of personal information is described in our Privacy & Cookie Policy. By using our website or services, you acknowledge that personal information may be processed as described in that policy.

17. Governing law and disputes

These terms are governed by the laws of the District of Columbia, without regard to conflict of law rules, unless a written agreement for a specific project says otherwise or applicable consumer law requires a different rule.

Before filing a claim, the parties agree to make a good-faith effort to resolve disputes by written notice and discussion. Send dispute notices to info@bytesncables.com and include your name, organization, project address if applicable, invoice or proposal number if available, a description of the issue and the resolution requested.

If the dispute is not resolved informally, the parties may pursue available remedies in a court with proper jurisdiction, unless a separate signed agreement requires another dispute process.

18. Miscellaneous terms

Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including severe weather, supply shortages, labor disruptions, accidents, illness, emergencies, utility outages, internet outages, manufacturer delays, acts of government, permitting delays, site shutdowns, civil unrest, war, terrorism, natural disasters or similar events.

Electronic communications

You agree that emails, electronic approvals, online forms, digital signatures and electronic records may satisfy written communication and signature requirements where permitted by law.

Assignment

You may not assign a proposal, project or these terms without our written consent. We may assign rights or obligations to an affiliate, successor, subcontractor or service provider as needed to perform services or operate our business.

Severability

If any part of these terms is found unenforceable, the remaining terms remain in effect, and the unenforceable term will be modified to the minimum extent necessary to make it enforceable where permitted.

Changes to these terms

We may update these Terms of Service from time to time. The updated version will be posted on our website with a new effective date. Changes do not retroactively modify an accepted written proposal unless the parties agree in writing.
